Clear rules for using FocusPrep.
The short version for learners and families
- A parent or carer should create and manage a child's account.
- Use FocusPrep for learning, keep the account secure and treat other people's work respectfully.
- Explanations and AI output can make mistakes. FocusPrep supports learning but does not guarantee an exam result.
- Australian consumer rights continue to apply and are not excluded by these terms.
1. Agreement and who may use the service
These terms form an agreement between the person responsible for the account and FocusPrep. By creating an account or using the service, that person agrees to these terms and acknowledges the Privacy Policy.
FocusPrep is designed for school-aged learners. A parent, carer, teacher or other authorised adult must create or approve a child's account, supervise its use and ensure the details provided are accurate.
2. What FocusPrep provides
FocusPrep provides educational activities, practice, explanations, learner progress records and optional AI-supported learning features. It is a training resource, not the NSW Department of Education, an official test provider or a guarantee of placement or exam performance.
Learning feedback, mastery estimates and recommendations are educational indicators. Families and educators should use their own judgement and official sources when making education decisions.
3. Accounts and security
You must provide accurate account information, keep passwords and confirmation links confidential, and tell us promptly if an account may have been accessed without permission.
You are responsible for activity performed through the account unless it results from a security failure within our reasonable control. Do not share one account beyond the learner and responsible adults it was created for.
4. Acceptable use
You may use FocusPrep for personal, family or authorised classroom learning. You must not:
- interfere with the service, bypass security or probe systems without written permission;
- use automated tools to scrape, copy or overload the service;
- upload unlawful, harmful, abusive or privacy-invasive material;
- impersonate another person or access another learner's records;
- copy, sell or publicly distribute substantial parts of FocusPrep content except where the law permits.
5. Learner-created content
Learners keep ownership of original writing, designs and other work they create. The account holder gives FocusPrep a limited permission to host, process, display and back up that work only as needed to provide, secure and maintain the service.
Do not submit material that infringes another person's rights or contains unnecessary personal or sensitive information. We may remove content where reasonably needed for safety, law or service integrity.
6. AI-supported features
Some features may use artificial intelligence to generate explanations, prompts or feedback. AI output can be incomplete, inaccurate or inappropriate for a particular learner. It should be checked against the question evidence, trusted educational sources and adult judgement.
Do not enter passwords, contact details, health information or other sensitive information into AI-supported text fields. We may change, limit or disable an AI provider or feature when needed for safety, quality, cost or availability.
7. Paid plans, cancellations and refunds
If paid plans are offered, the price, billing period, included features and renewal terms shown at purchase form part of these terms. You may cancel future renewal using the method shown with the subscription. Cancellation does not remove access already paid for unless the purchase terms say otherwise.
Refunds and remedies are provided where required by the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies a consumer guarantee or other right that cannot lawfully be excluded.
8. Availability and changes
We aim to provide a reliable service, but maintenance, provider outages, security events and product changes can interrupt availability. We may add, change or retire features and content. Where a material change affects a paid plan, we will provide reasonable notice when practicable.
9. FocusPrep content and intellectual property
FocusPrep and its licensors own the service software, branding, original questions, illustrations and other supplied content. Subject to these terms, we grant the account holder a limited, non-exclusive, non-transferable licence to use that content for the authorised learner's personal or classroom learning.
10. Responsibility and liability
To the maximum extent permitted by law, FocusPrep is not responsible for indirect or consequential loss caused by use of, or inability to use, the service. We do not exclude responsibility that cannot lawfully be excluded, including applicable Australian Consumer Law guarantees.
Where a guarantee applies and the law permits the remedy to be limited, our responsibility may be limited to supplying the service again or paying the reasonable cost of having it supplied again.
11. Suspension and account closure
We may suspend or close an account where reasonably necessary to address serious or repeated breaches, protect learners or the service, comply with law or prevent fraud. We will consider the circumstances and, where appropriate, give notice and a chance to respond. An account holder may request closure by contacting kedarshenoy@gmail.com.
12. Governing law, changes and contact
These terms are governed by the laws of New South Wales, Australia, subject to any rights under the law of another place that cannot be excluded.
We may update these terms to reflect service or legal changes. We will publish the revised effective date and provide additional notice before a material change takes effect where reasonably practicable.
